Different systems. Useful questions. | A question to investigate
US PBM relationships | Ask a sharper contract question
An apparently simple medicines price can sit inside a complicated relationship. Employers, plans, pharmacies and pharmacy benefit managers may describe different parts of the same transaction. We want a proposed review to help an authorised buyer separate those perspectives and identify the evidence needed for a specific decision, rather than turn a public headline into an unsupported judgement about their own contract.

Who would use the review
The relevant buyer could be a health-plan pharmacy lead, an employer benefits adviser acting with authority or an organisation reviewing its pharmacy arrangements. The decision might concern which questions to ask before a renewal or whether a reported discrepancy warrants specialist investigation. The incentive is a better prepared discussion. Contract interpretation and procurement advice would remain with appropriately appointed advisers; PHARMORIS would not claim to replace them.
Read the evidence at its real scope
The FTC’s January 2025 interim staff report examined specialty generic transactions from 2017 to 2022 (FTC, 2025). We would preserve that historical scope and distinguish the report’s findings from current, organisation-specific evidence. It cannot establish the terms of every PBM relationship. The proposed review would identify exactly which question a publication informs and which questions still require the buyer’s authorised records, contract definitions or a response from the relevant counterparty.
Build a transaction vocabulary first
Before comparing numbers, we would agree what each field represents: a published benchmark, an invoiced amount, an allowed amount, a fee or a subsequent adjustment. Medicaid’s pharmacy-pricing resources can inform benchmark context, but a benchmark is not the same as a confidential net commercial position (CMS, n.d.). The output should retain these distinctions in plain language so the buyer can see where a comparison is meaningful and where it is incomplete.
A bounded document review
An initial evaluation could examine one defined question using redacted, authorised contract extracts, public sources and an aggregate transaction example supplied by the buyer. The comparator would be the organisation’s existing preparation method. A reviewer would check whether each material statement can be traced to a source and whether an unresolved term has been honestly labelled. No market-wide accusation or counterpart ranking would be a default output.
A public decision brief | An illustrative example
Open the question.
Inspect the reasoning.
Choose a business question, then look beneath its claim. See what a public source supports, what depends on the local setting and what a useful next step could be.
A US-facing medicines business, analyst or research team deciding whether a public spending comparison is meaningful.
The same medicine. A different denominator.
A spending figure becomes useful when the reader knows the programme, period, unit and exclusions behind it. Reconciliation comes before an attractive price comparison.
A proposition to investigate
A comparable question before a bigger chart.
A public-data brief could identify whether two measures describe sufficiently similar activity to compare. The proposed value is a traceable inclusion decision and a clear definition of the measure. No current price, negotiated saving, purchasing recommendation or live dataset calculation is produced in this specimen.
The reconciliation task is constructed. No records have been joined or analysed in this example.
What the next brief would contain
A decision someone
can commission.
- The decision
- Whether a defined public-data comparison is valid enough to commission.
- The comparator
- A second explicitly defined source with comparable scope, units and period.
- The evidence
- Source editions, medicine mapping, population, units, exclusions and reproducible inclusion rules.
- Stop or redesign
- Exclude comparisons when the denominator or cost meaning cannot be reconciled; retain the exclusion reason.

Keep this example briefMeasure usefulness without promising recovery
Proposed measures include time to prepare a review, ambiguous definitions found, missing documents identified and questions that an accountable adviser considers worth pursuing. A claimed financial discrepancy would need independent reconciliation before it is treated as real. We would distinguish a potential issue from an amount recoverable under a contract. Finding a question to investigate is useful, but it is not evidence of reimbursement, damages or future savings.
Keep the review fair and confidential
A buyer’s concern is a starting hypothesis rather than a verdict. The workflow should retain explanations that weaken the hypothesis as well as those that support it. Commercially sensitive terms would remain within agreed access and retention arrangements. Public copy would not name a counterparty as having behaved improperly on the basis of a pilot. The organisation would decide how a verified issue is escalated through its own advisers and governance.
When the answer is a different service
We would stop if the work requires legal interpretation, audit authority or information the buyer cannot lawfully supply. A useful result may be a referral to a specialist or a finding that the available data cannot answer the question. A wider agreement would require evidence that structured preparation improves a recurring decision. The commercial value lies in better questions and traceable reasoning, not a guarantee that every contract contains a recoverable problem.

Discuss a PBM evidence question
Bring the decision you need to make, the person accountable for it and the evidence you can use. We can then discuss whether a bounded PHARMORIS evaluation is the right next step.
Another useful angle.
- US accountable care | Connect a medicines question to the right incentive
A proposed PHARMORIS evaluation for accountable care organisations, focused on a specific medicines-related workflow and appropriately bounded evidence.
- US Medicaid programmes | Read the state, the programme and the data
A proposed Medicaid medicines-data review separating state utilisation, reimbursement benchmarks and the local authority needed for evaluation.
